Privacy Policy

Fulfilment of the duty to provide information under Art. 19 of the revised Federal Act on Data Protection (FADP, SR 235.1, in force since 1 September 2023) for the muldex.ch platform. Translation of the German version, which prevails.

1. Controller (Art. 5 let. j FADP)

The controller within the meaning of Art. 5 let. j FADP for the data processing described on this website is:

Prorec GmbH
Güterstrasse 12, 3360 Herzogenbuchsee, Switzerland
UID CHE-295.370.815
Email: info@muldex.ch
Telephone: +41 76 410 29 88

Prorec GmbH is a company domiciled in Switzerland. A representative within the meaning of Art. 14 FADP is not required. No data protection advisor under Art. 10 FADP has been appointed; enquiries are answered directly by the management.

2. Processing principles (Art. 6 FADP)

Prorec GmbH processes personal data exclusively in a lawful manner, in good faith, proportionately and for specific purposes (Art. 6 paras 1–3 FADP). Personal data is destroyed or anonymised as soon as it is no longer required for the respective purpose (Art. 6 para. 4 FADP). There is neither high-risk profiling nor any automated individual decision within the meaning of Art. 21 FADP.

3. Processing in detail

3.1 Visiting the website and server log files

When you visit this website, the hosting provider records technically necessary connection data in server log files, in particular:

  • anonymised or truncated IP address;
  • date and time of the request;
  • URL accessed, HTTP status code, volume of data transferred;
  • referrer and user agent (browser and operating system identifier).

Purpose: delivering the content, stability and security of the web server, preventing and investigating cyberattacks (Art. 8 FADP, data security).
Ground for justification: overriding interest of Prorec GmbH in the secure operation of its online presence (Art. 31 para. 1 FADP).
Retention: as a rule 30 days; longer in the event of incidents, where necessary to preserve evidence.

3.2 Online order form for skips and containers

When you use the order form on muldex.ch, the data you enter is processed, in particular:

  • first name and surname, company (optional);
  • delivery address (street, house number, postcode, town, optional notes on the location);
  • email address and telephone number;
  • order details: selected waste type, container size, preferred date, calculated final price;
  • time of the order and a technical order number.

Purpose: processing your order, order confirmation, delivery, invoicing and performance of the contract.
Ground for justification: contractual or pre-contractual measure within the meaning of Art. 31 para. 2 let. a FADP; alternatively, consent under Art. 6 para. 6 FADP by submitting the form.
Retention: correspondence relevant to the contract is kept for ten years in accordance with Art. 958f CO. Orders that do not result in a contract are generally deleted after twelve months, unless there is a longer statutory retention obligation.

Optional details about the spot: if you wish, you can take or choose a photo of the spot in the order form and send your current location (GPS coordinates with an accuracy figure). Both happen only when you actively choose to — your browser asks for permission first — and serve solely to find and assess the spot for the delivery. A Muldex logo is added to the photo; in the process, the camera data stored in the image file (such as an embedded location) is removed. The photo and the location are sent to us by email together with the order and are not stored on the web server; they are kept on the same terms as the rest of the order data. The legal basis is your consent (Art. 6(6) FADP), which you can withdraw at any time.

No data is disclosed to third parties, except to the processors named in section 3.4 or where there is a legal obligation to hand it over.

3.3 Cookies and similar technologies

This website uses only technically necessary mechanisms, namely session cookies and your browser’s local storage for temporarily saving your progress in the multi-step order form. No marketing, tracking or analytics cookies are used; a cookie banner is therefore not required.

The temporarily saved data remains exclusively in your browser and is only transmitted to Prorec GmbH when you submit the order form. You can delete your browser’s local storage manually at any time.

3.4 Processors (Art. 9 FADP)

To process your orders, Prorec GmbH uses the following carefully selected processors:

  • Email delivery: Resend Inc., 2261 Market Street #5039, San Francisco, CA 94114, USA — for the transactional sending of the order confirmation to the customer and of the internal order notification to Prorec GmbH.
  • Hosting / application operation: the hosting provider of this website (server location Switzerland or EU). The provider’s exact name is disclosed on request.

All processors are contractually bound to confidentiality and to compliance with Swiss data protection law (Art. 9 FADP).

3.5 Disclosure abroad (Art. 16 / 17 FADP)

Where personal data is transferred to Resend Inc. in the USA, this disclosure has, since 15 September 2024, been based on the Federal Council’s adequacy decision on the Swiss-U.S. Data Privacy Framework within the meaning of Art. 16 para. 1 FADP. Where the recipient is not certified under the Framework, the disclosure is based on standard data protection clauses recognised by the FDPIC (Art. 16 para. 2 let. d FADP).

3.6 Email and telephone communication

If you contact us by email or telephone, we process your communication data in order to respond to your enquiry. Please note that unencrypted email transmission over the internet does not offer complete protection against unauthorised access. For sensitive content (contracts, confidential business information), we recommend sending it by post or handing it over in person.

4. Data security (Art. 8 FADP)

Prorec GmbH takes appropriate technical and organisational measures to protect the personal data processed against unauthorised access, loss, alteration and accidental or intentional destruction. These include in particular TLS encryption of the website (HTTPS), access control to business systems on a need-to-know basis, regular updates and backup concepts. The measures are reviewed periodically and adapted to the state of the art.

5. Duty to report data security breaches (Art. 24 FADP)

In the event of a data security breach that is likely to result in a high risk to the personality or fundamental rights of the data subjects, Prorec GmbH reports the incident as quickly as possible to the Federal Data Protection and Information Commissioner (FDPIC). If you are affected and the information is necessary for your protection, you will also be notified directly (Art. 24 para. 4 FADP).

6. Your rights as a data subject

You have in particular the following rights vis-à-vis Prorec GmbH:

  • Right of access (Art. 25 FADP): you can request, free of charge, information on whether and which personal data about you is being processed. The information is generally provided within 30 days.
  • Rectification (Art. 32 para. 1 FADP): you can request that inaccurate personal data be corrected.
  • Erasure or destruction: you can request that personal data be erased or destroyed, provided that no statutory retention obligation (e.g. Art. 958f CO) prevents this.
  • Data release / data portability (Art. 28 FADP): you can request that the personal data you have disclosed be handed over to you in a commonly used electronic format.
  • Restriction & objection: you can object to the processing; we examine the objection in accordance with Art. 30 et seq. FADP.
  • Withdrawal of consent: you can withdraw any consent you have given at any time with effect for the future.

To exercise your rights, an informal message to info@muldex.ch is sufficient. For reasons of data security, a copy of an official identity document may be requested for unambiguous identification (Art. 19 of the Ordinance to the FADP, Data Protection Ordinance, DPO).

7. Supervisory authority

If you believe that your data protection rights have been violated, you can contact the competent federal supervisory authority:

Federal Data Protection and Information Commissioner (FDPIC)
Feldeggweg 1, 3003 Bern
Telephone +41 58 462 43 95

8. Applicable law

This privacy policy is governed exclusively by Swiss law. Where the processing concerns persons in the European Union, supplementary application of the EU General Data Protection Regulation (GDPR) remains reserved.

9. Updates

Prorec GmbH reviews this privacy policy periodically and adapts it in the event of factual or legal changes. The current version published at muldex.ch/en/privacy applies; in the event of any discrepancy, the German version prevails.
